Consequences of a Shoplifting Conviction

If you plead or are found guilty to any shoplifting
charge either in municipal or superior court you will be
subject to the following penalties: (No Exceptions)
1. You will have a criminal record. A Criminal record may prevent you from
finding employment, seeking financial aid, buying a house, renting an
apartment, or even traveling outside the country.
2. You may go to Jail or Prison. (no matter how small a sum you shoplift the
judge can order you to go to jail even for a first offense)
3. You will have to pay Fines and Court Costs.
3. If you are lucky and get only Probation instead of jail or in addition to jail,
you will have to submit to random drug and urine testing and pay a fee to the
probation department. If you violate Probation such as stay out later than
your allowed, travel outside a designated area, leave the state or country or
go to a forbidden store you will generally go immediately to jail.
4. In indictable matters (shoplifting charges over $200.00), you will be
required to provide a DNA sample, which could be used by law enforcement
for the investigation of criminal activity, and pay for the cost of testing.
5. You must pay restitution if the court finds there is a victim (store) who has
suffered a loss. (example the clothing was damaged by removing a tag you
will have to pay for the full retail value of the item not the sale price)
6. If you are a public employee of a government agency, school teacher or
an office holder, you can be required to forfeit your job, pension or office by
virtue of your plea of guilty.
7. If you are not a United States citizen or national, you may be deported by
virtue of your plea of guilty.
8. You must wait 5-10 years to expunge a first offense. 2C:52-3 and even if
expunged certain parties and employers may still see your guilty plea.
9. You can be sued by the store for the stores cost of defending the
shoplifting case.
10. You will be required to do Community Service.
11. Additional penalties may apply if ordered by the judge, some common
orders include: You are not to shop at a certain store, you are not to shop at
any malls, etc.
12. Increased costs for homeowners, apartment, life insurance and car
insurance for the rest of your life with many insurance companies refusing to
insure you due to the fact that you are considered a "poor moral hazard."
